New York Adoption Lawyers Guide You Through the Process

The adoption process is rife with legal procedures, guidelines and requirements. New York requires all adoptive parents to become certified by the court in order to pursue domestic adoption. Under New York State law, adoptive parents must file a formal petition with the court, supply a significant amount of information and meet certain qualifying criteria.

Some of the information that will be evaluated includes:

  • Marital and family status of the adoptive parent(s)
  • Physical and mental health of the adoptive parent(s)
  • Property owned by and the income of the adoptive parent(s)
  • Whether the parent(s) have previously applied for a certification
  • Child abuse clearance
  • Criminal background check

One of the most essential parts of the pre-certification process is the adoption home study. This pre-placement investigation will provide information about your family's lifestyle. During the pre-placement investigation, a social worker will visit your home primarily to evaluate the environment you will provide and your ability to meet a child's needs. They will then submit a written report to the court within 30 days of the study.
